By accessing and using Trend India's website and services, you accept and agree to be bound by these Terms of Use, our Privacy Policy, and our Refund Policy. These terms constitute a legally binding agreement between you and Trend India.
Trend India provides the following services:
All services are provided on a project basis with specific terms outlined in individual service agreements.
Upon full and final payment for services rendered, ownership of the final deliverables (website, software, mobile application) is transferred to the client. However, Trend India retains:
Clients warrant that any materials (text, images, logos, etc.) provided for use in the project are either owned by the client or the client has obtained necessary permissions for their use. The client indemnifies Trend India against any claims arising from unauthorized use of third-party materials.
All content on the Trend India website, including text, graphics, logos, images, and software, is the property of Trend India or its content suppliers and is protected by intellectual property laws.
When engaging our services, clients agree to:
Provide accurate and complete information necessary for project completion, including business requirements, design preferences, and technical specifications.
Review deliverables in a timely manner and provide constructive feedback. Delays in feedback may affect project timelines.
Make timely payments as outlined in the service agreement. Late payments may result in project delays or suspension of services.
Provide all necessary content (text, images, logos) in the agreed format and within the specified timelines.
Ensure that the project requirements and content comply with all applicable laws and regulations.
Failure to fulfill client responsibilities may result in project delays, additional costs, or termination of services as outlined in the service agreement.
Unless otherwise specified in the service agreement, the standard payment schedule is:
Payments overdue by more than 15 days may incur a late fee of 2% per month on the outstanding balance. Services may be suspended for payments overdue by more than 30 days.
Clients are responsible for third-party costs including but not limited to domain registration, hosting, premium plugins, APIs, and stock images unless otherwise agreed in writing.
Project timelines are estimates based on the project scope and client requirements. Timelines may be affected by:
Clients have 7 business days from project delivery to report any bugs or issues. After this period, the project is considered accepted unless otherwise agreed in writing.
Each project includes a specified number of revision rounds as outlined in the service agreement. Additional revisions may incur extra charges.
Trend India shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service in question during the six-month period preceding the claim.
Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:
You agree to indemnify, defend, and hold harmless Trend India and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use.
Clients may terminate services as outlined in the Refund Policy and service agreement. Early termination may result in charges for work completed up to the termination date.
Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Trend India regarding our services and supersede and replace any prior agreements we might have had between us regarding the services.
